Prima Pour
Mobile Bartending: Dry Hire Terms and Conditions

These Terms and Conditions, in conjunction with the signed Mobile Bartending Agreement, govern the provision of bar services by Prima Pour (the "Bartender" or "Service Provider") to the Client for the specified event.

1. Scope of Service (Dry Hire Model)

 

A "Dry Hire" is defined as a service where Prima Pour provides professional bartending labor, bar equipment, and supplies, but the Client is exclusively responsible for procuring and supplying all alcoholic beverages, beer, and wine (the "Alcohol").

 

1.1 Prima Pour Responsibilities (Included in Base Fee):

  • Personnel & Service: Bartender(s) for up to five (5) hours of bar service.

  • Equipment & Supplies: A basic bar setup (including two tables with tablecloths), standard bar tools, necessary garnishes (limes, lemons, oranges, and cherries), and cups (12 oz cocktail, 9 oz wine, and 1 oz shot cups).

  • Planning: Preparation, travel up to 40 miles (additional travel fees apply thereafter), and a 1:1 consultation/Google Meet call with a complete Alcohol shopping list.

  • Insurance: Prima Pour carries its own liability insurance.

1.2 Client Responsibilities (Dry Hire):

  • Alcohol Provision: The Client is solely responsible for purchasing, transporting, and supplying all Alcohol to the event venue.

  • Legal Compliance: The Client is responsible for ensuring that the amount of Alcohol purchased and the venue chosen complies with all applicable state laws and venue regulations in Puerto Rico, as Prima Pour operates separately from the venue.

  • Additional Supplies: The Client is expected to supply any additional garnishes, specialized ingredients, or rented glassware.

  • Trash Disposal: Prima Pour will not provide trash bags or trashcans and will not remove trash from the event site. Full trash bags will be left on-site in the location agreed upon by the Client.

2. Payment, Fees, and Cancellation

 

2.1 Deposit and Payments

  • A deposit equal to 50% of the total agreed-upon fee is required to secure the event date and is due upon completion of the contract.

  • All deposits are non-refundable.

  • The remaining 50% balance is due thirty (30) days prior to the event date.

  • Processing Fee: All credit card payments are subject to a 3% processing charge.

2.2 Additional Fees

  • Additional Bartender: An additional fee of $300 per bartender is required for events larger than 75 guests.

  • Travel Fee: A charge of $1 per mile applies for every mile traveled over the initial 40 miles included in the base fee.

  • Minimum Gratuity: Prima Pour requires a guaranteed minimum gratuity of $250 per bartender. If the collective amount in the tip jar does not reach this minimum per bartender, the Client is expected to cover the difference via cash or credit at the conclusion of the service.

2.3 Cancellation and Force Majeure

  • Client Cancellation: Deposits are non-refundable regardless of the reason for cancellation.

  • Acts of God/Unforeseen Circumstances: Due to unforeseen circumstances, acts of God (such as natural disasters or emergencies), Prima Pour is able to reschedule the event. Any rescheduled event must occur within the next calendar year and is subject to the Service Provider's availability.

3. Alcohol Service Standards and Liability

3.1 Service Requirements and Limitations (Puerto Rico)

  • Age Restriction: Prima Pour will not serve alcoholic beverages to anyone under the age of 21.

  • Refusal of Service: Prima Pour reserves the right to refuse service to any individual who appears to be intoxicated and may request them to leave the premises.

  • Shot Service: The availability of 1 oz shot cups is included, but shot service is contingent upon and limited by Prima Pour's insurance policy.

3.2 Indemnification and Hold Harmless

The Client agrees and by their signature(s) to indemnify and hold harmless Prima Pour from any claims, damages, or liabilities arising from the following:

  • Any person or persons consuming or transferring foods or beverages removed from the venue by any person, which causes sickness or conditions leading up to and including death.

  • Any claims resulting from the number of guests exceeding the amount guaranteed in the contract or running out of beverages or services to properly serve attendees.

  • Any liability related to other vendors (i.e., catering, coordinating, entertainment, and venue) or pre-existing conditions that may cause harm at the venue and/or property.

4. Venue and Staff Requirements

 

4.1 Venue Conditions

  • Venue Compliance: The Client understands that the venue ultimately dictates the bar services Prima Pour is legally allowed to provide. The Client must confirm all details with the venue prior to completing this contract, as the deposit is non-refundable.

  • Outdoor Bar: If the bar is located outdoors, Prima Pour requires an adequate covered space for protection against inclement weather, which is necessary to perform duties efficiently.

  • Staff Safety: The Client is responsible for ensuring all Prima Pour staff are provided a safe and comfortable work environment, free from any physical or emotional danger.

  • Lighting: Adequate lighting must be provided, especially for outdoor service.

  • Set Up: The Client must provide a floor plan or instructions on the bar setup location.

4.2 Staff Requirements

  • Meals: Meals are required for all Prima Pour staff.

  • Branding: Prima Pour reserves the right to display its branding, business cards, or other marketing materials at the bar setup during the event.
